1. Introduction and Scope of Services

This Disclaimer & Waiver applies to all services offered by SpiritCode Institute PTY LTD (ABN: 61930251867), including but not limited to:

• Personal Coaching and Mentoring: Support and guidance to help you achieve personal and professional goals.
   
• Channelling: Spiritual and intuitive guidance through channeled messages and information.
   
• Kinesiology: Energetic balancing and stress relief techniques.
   
• Energy Healing: Techniques designed to support energetic balance, emotional well-being, and personal growth.
   
• Teaching & Educational Programs: Courses, workshops, classes, and trainings focused on personal, spiritual, energetic, or professional development.
   
• Business Coaching and Mentoring: Guidance and strategic coaching to support business-related goals and professional development.

4. No Guaranteed Outcomes

You explicitly acknowledge and understand that:

• SpiritCode Institute PTY LTD makes no guarantees, promises, or representations regarding specific outcomes or results from coaching, channelling, energy healing, kinesiology, business mentoring, or any other service provided.
   
• Services provided by SpiritCode Institute PTY LTD aim to support your goals and intentions but do not guarantee specific results, including but not limited to improvements in health, emotional state, personal relationships, spiritual growth, financial success, business outcomes, profitability, or clientele increase.
   
• All decisions and actions you take based on advice, suggestions, or guidance provided are made entirely at your own risk and responsibility.

5. Confidentiality and Limitations

You acknowledge and agree that:

• SpiritCode Institute PTY LTD will maintain confidentiality regarding personal and sensitive information you disclose during coaching, channelling, kinesiology, energy healing, or other sessions, unless you explicitly provide written consent to disclose such information.
   
• Confidentiality exceptions apply where required by law or ethical guidelines, including situations involving:

  • An imminent threat of harm to yourself or others.

6. Technology and Security

You acknowledge and agree that:

• Communication via email, messaging, video conferencing platforms (such as Zoom, Skype, or similar), phone calls, and other electronic means may not be completely secure.
   
• By engaging in services delivered through technology, you understand and accept the inherent risks to confidentiality and security associated with electronic communications.
   
• SpiritCode Institute PTY LTD is not liable for any breaches of privacy or confidentiality that result from the use of such technology-based communication.

7. Confidentiality and Mandatory Reporting

You acknowledge and agree that:

• SpiritCode Institute PTY LTD will keep all information you share during coaching, channelling, teaching, or healing sessions strictly confidential, except where required by law or where disclosure is necessary for safety reasons.
   
• Confidentiality may be breached if:
   
  • You disclose intentions to harm yourself or others.
     
  • You disclose situations involving suspected child abuse, elder abuse, or neglect.
     
  • We are required by law, court order, or subpoena to disclose information.
     
• Outside of these exceptions, SpiritCode Institute PTY LTD commits to maintaining strict confidentiality and will not disclose your information without your written consent.

• This waiver and release of liability includes, without limitation, claims arising from negligence or omission by you or by SpiritCode Institute PTY LTD, and binds your heirs, executors, personal representatives, successors, assigns, and agents.
   
• You confirm that no promise, inducement, or agreement not expressly stated in this document has been made to you to sign this waiver.

You acknowledge, agree, and explicitly confirm that:

Results & Earnings Disclaimer

You acknowledge and agree that SpiritCode Institute PTY LTD makes no guarantees or representations regarding specific outcomes or results. Any testimonials or examples provided represent possible outcomes only and are not indicative of guaranteed results. Your individual outcomes depend entirely on your own actions, commitment, and implementation.

Technology and Communication Risks

You explicitly acknowledge and accept that digital communication methods (including email, messaging apps, video conferencing, phone calls, or other digital platforms) used by SpiritCode Institute PTY LTD may not be entirely secure. You voluntarily accept the inherent confidentiality risks associated with digital communications and waive any claims against SpiritCode Institute PTY LTD for breaches of confidentiality or privacy arising from such technology use.

Recording Consent

By participating in group sessions, workshops, webinars, courses, or other interactive online offerings, you consent to sessions being recorded. You agree that SpiritCode Institute PTY LTD may use these recordings for educational, promotional, or training purposes. If you do not wish to be recorded, you must notify us in advance and may choose not to participate in the recorded session.

Intellectual Property & Copyright

All content, teachings, materials, methodologies, and information provided by SpiritCode Institute PTY LTD remain the exclusive intellectual property of SpiritCode Institute PTY LTD. You agree not to reproduce, copy, distribute, share, or sell any provided materials, content, recordings, or information without explicit written permission from SpiritCode Institute PTY LTD.

Right to Refuse or Terminate Services

SpiritCode Institute PTY LTD reserves the right, at our sole discretion, to refuse, terminate, or suspend services without refund if you engage in conduct we deem inappropriate, disrespectful, disruptive, abusive, or otherwise harmful to the integrity of our programs, other participants, or SpiritCode Institute PTY LTD itself.

Indemnification Clause

You explicitly agree to indemnify and hold harmless SpiritCode Institute PTY LTD and its directors, officers, employees, contractors, representatives, and agents from any claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising directly or indirectly from your breach of this agreement or from your actions or decisions related to the services provided.

Emergency & Crisis Situations

You acknowledge and agree that SpiritCode Institute PTY LTD services are not appropriate for emergency or crisis situations. If you are experiencing a mental health crisis or emergency, you explicitly agree to immediately seek assistance from emergency services or qualified healthcare professionals.

Intellectual Property & Trademark Notice

All content, teachings, methodologies, proprietary techniques, channelled information, terminology, programs, course materials, processes, branding, trademarks (registered or unregistered), trade names, logos, and all other intellectual property developed and provided by SpiritCode Institute PTY LTD (ABN: 61930251867) and Athina Krol are strictly proprietary and protected under Australian and international copyright and trademark laws.

By participating in, purchasing, or accessing our teachings, courses, coaching programs, channelling, intuitive guidance, mentoring, kinesiology, energy healing, business coaching, or any related services provided by SpiritCode Institute PTY LTD, you explicitly agree that:

• You will not copy, reproduce, duplicate, modify, distribute, sell, resell, share, rebrand, repackage, republish, or otherwise exploit any content, teachings, proprietary methods, channelled materials, course resources, programs, manuals, trademarks, branding, logos, or methodologies without explicit written consent from SpiritCode Institute PTY LTD.
   
• All materials, teachings, and proprietary methods are provided exclusively for your personal use, growth, and development and must not be used in your own coaching, healing practice, teaching, or professional work in any form without explicit written permission and a formal license or certification granted directly by SpiritCode Institute PTY LTD.
   
• You acknowledge that the teachings and methods provided are proprietary, unique, and exclusively developed and channelled by Athina Krol and SpiritCode Institute PTY LTD. You agree not to represent, imply, or suggest, directly or indirectly, that these teachings or proprietary methods are your own, or originated from any other source besides SpiritCode Institute PTY LTD and Athina Krol.
   
• Violation of this agreement may result in immediate legal action, including claims for damages, financial compensation, and injunctions to cease unauthorised use, without further notice.
   
• SpiritCode Institute PTY LTD reserves the right to terminate your access to all services, programs, and materials immediately upon discovering any breach or infringement of these terms, without any obligation to refund or compensate.
   

Your explicit cooperation, integrity, and respect for these proprietary teachings and intellectual property rights are essential and expected.
